Department of Revenue Extends State Sales Tax Deadline

BATON ROUGE, La., (LDR) – Businesses have additional time to file returns due this month for sales and excise taxes collected by the Louisiana Department of Revenue (LDR). The extended deadline is May 20, 2020, for applicable returns and payments that were due Friday, March 20.

The extension applies to sales, beer excise and wine excise tax returns and payments for the February 2020 tax period. By state law, sales and excise tax returns for any monthly tax period are generally due on the 20th day of the following month. However, LDR is extending this month’s deadline due to the public health emergency caused by the coronavirus pandemic. This is an automatic extension and no extension request is necessary.

LDR will waive penalties and interest for applicable returns and payments received by the extended May 20 deadline.

Statewide OMV Locations to Close due to ​COVID-19 Precautions

Due to precautions related to the COVID-19 response, Louisiana Office of Motor Vehicles Commissioner Karen St. Germain has announced that all OMV locations across the state will be closed effective Friday, March 20, 2020. During the closure, online OMV services will remain available to the public. Citizens may also take advantage of available Public Tag Agent locations.

Customers are urged to utilize the OMV website at http://www.expresslane.org for an updated list of open Public Tag Agent locations and a complete list of available online services.

Additionally, LA Wallet, the state of Louisiana’s official digital driver’s license, is now available to residents free of charge. The all digital identification and driver’s license app will suspend its fee in response to the COVID-19 pandemic. The app is available to download on Apple and Android devices by searching LA Wallet.

The entire Department of Public Safety remains committed to ensure public safety and service to the citizens of Louisiana remains a top priority.

Throughout the closure, licensing and registration requirements remain waived through Governor John Bel Edwards’Emergency Proclamation:

1. Late fees for driver’s license which expire between March 9, 2020 through May 10, 2020, are suspended until May 20, 2020.
2. Penalties and interest due on state and local sales and use taxes collected by the Office of Motor Vehicles which began on or after March 9, 2020 are suspended and are waived until June 19, 2020.
3. The three-day period mandated in LA R.S. 32:863.1 to appear at an Office of Motor Vehicle field office for a notice of violation served on or after March 9, 2020 but before May 10, 2020, is suspended until May 13, 2020.
4. The expiration date of temporary registration plates issued pursuant to LA R.S. 47:519 and La. R.S. 47:519.2 which expired on or before March 9, 2020 is suspended until May 10, 2020.
5. The expiration date of license plates issued pursuant to LA R.S. 47:462 which expired on or after March 9, 2020 but before May 10, 2020 is suspended until May 10, 2020.
6. The notice of default issued pursuant to LA R.S. 32:429.4 that would be issued on or after March 9, 2020 and before May 15, 2020 is suspended, and the notices will not be issued until after May 15, 2020.
7. The expiration date of an apportioned registration issued under the International Registration Plan which expires March 9, 2020 is suspended and the expiration date is extended to May 10, 2020.
8. The period to request an administrative hearing submitted to the Department pursuant to LA R.S. 32:667, LA R.S. 32:863, LA R.S. 863.1 and LAC Title 55, Part III, Chapter 1, §159 which expired on or after March 9, 2020 but before May 10, 2020 are suspended and extended until June 10, 2020.
9. The sixty-day delay for the Department to submit the administrative hearing record to the Division of Administrative Law pursuant to LAR.S. 32:667(D)(1) for an arrest which occurred on or after March 9, 2020 but before May 10, 2020 is extended until August 8, 2020.
10. The expiration date of driver’s licenses which expire on or after March 9, 2020, but on or before May 10, 2020, is suspended and the expiration date is extended to May 20, 2020.
11. Extend the expiration of temporary driver’s license issued pursuant La R.S. 32:667A which were issued on or after March 9, 2020 through May 10th, 2020 until June 9th, 2020.
12. All students who enroll in a driver’s education course after March 9, 2020 shall be allowed to begin the driver’s education course without the issuance of the temporary instructional permit until May 10, 2020.
13. Any suspension with the official notice of withdrawal issued on or after Feb 17, 2020 but before May 10, 2020 shall remain in pending until June 9, 2020.

Clergy Corner with Father Frank Fuller

I share with many others some of the great variety of ways that Christians observe Lent. Some fast, or practice an additional data devotion, or join a study group, or make an extra effort to get to church for Ash Wednesday, Good Friday, or the usual Sunday service. In most everyone at least thinks about giving up something for Lent. Due to the precautions we are taking to protect ourselves and each other from the latest pestilence, it seems like we’re giving up Lent for Lent.

Of course, it’s always interesting to hear what people say they are choosing to give up. Not usually work or school or Lenten study groups, and certainly not Church. Television and social media used to be common, but right now they’re essential to this new, isolated life. Candy, or perhaps chocolate. Wine or red meat. Something we like; occasionally, something we suspect we like a little too well.

Lent is an echo of our abundant blessing, for the blessing that surrounds us all is that we can choose what to surrender. We are, all of us, so endowed with the gifts of this world that there is a menu, a plenitude, of things and habits and services that surround and support and tempt.

Lent is the time to punch a little hole among the items of that menu, To give up something in order to create a space for an appreciation of the blessings of God’s world … and the blessing of God’s word to us through the season. The simple ability to choose among things that can be given up is itself a celebration of God’s abundant gifts.

Imagine, for a moment, someone who had nothing to give, or who had so little that every possible choice became a cry of desperation. Food for one’s child? Safety to sleep through the night? Another month to live?

This year, everyone is told to give up something else: something not in the plan. We don’t get to choose, and the giving itself isn’t neither sacrifice nor sacrament so much as it is safety. Safety, and the instruction to rearrange our own lives in a way that benefits and protects the lives of all of us. That keeps us all mindful of the lives and frailties of others just as we are mindful of our own.

The Lenten Fast is, in reality, the celebration of the great abundant gifts we have, and a chance to part the curtain of material gifts to glimpse the greatest gift: the unmerited blessing of God’s love. This year, part of the blessing is that we shall surrender the holy time we share with God and with each other. To exchange Wednesday group or Sunday morning for silence. That silent time can become part of Lenten devotion, as well.

Before the quarantine came, we prayed the ancient Great Litany that Bishop Thomas Cranmer wrote in 1533. It is the first liturgy of any kind written in English, and is often joined the First Sunday in Lent. Along with Lenten devotion and fasting, the Litany directs our attention to the needs of all of the world, from Adam and Eve to the present day.

In Cranmer’s words, we pray “That it may please thee to visit the lonely; to strengthen all who suffer in mind, body, and spirit; and to comfort with thy presence those who are failing and infirm, [and] that it may please thee to support, help, and comfort all who are in danger, necessity, and tribulation.”

That it may please thee that, in this silent time we will know thee better through our own neighbors, endangered by virus, loneliness, exhaustion, or concern for the isolation of the present day and for the uncertainties of the days to come.
From the greatest to the least among us. From those who have no home to dwell in to those whose home becomes a forced refuge in time of plague. Indeed, for the whole world. It reminds us that we have much to work for, even more to pray for, and a very great deal be thankful for.

Deano Thornton speaks to Kiwanis After Hours

Deano Thornton spoke to Kiwanis on Monday, March 16, 2020 and  gave a short history of how the Hog Dog Trials got started. In 1994 the Chamber of Commerce was planning something for every month in 1995 to commemorate Earl K. Long’s birthday.

Claude L. O’Bryan came up with the idea to have a Hog Dog Baying Contest. They did not have anything for the month of March so that is when it was held and has been ever since. However, due to the situation going on this year with the coronavirus the Hog Dog Trials have been postponed until October with the full backing of promoter Jake Loiacana.

Every year the trials have gotten bigger since that first year. A conflict caused one year to be missed but it was very bad for the economy. After that a board was formed that included a representative from each civic club (Thornton is the Kiwanis representative) and the Fair Board and the Winn Riding Club. The board meets once a year. Uncle Earl’s Hog Dog Trials is copyrighted so that it cannot leave the parish.

Also the Legislature proved a special waiver that allows the Hog Dog Trials to be held. All others were stopped.

There are 4 baying contests in the series and this is the Super Bowl of Hog Dogs. It might be to our advantage for the Hog Dog Trials to be held in October which is the end of the season and not the beginning.
Thornton also answered questions about tests for the coronavirus and how the clinic was handling patients. The tests for COVID-19 are tested in two labs (Lab Corp and Quest). The results are sent to Baton Rouge and then to the doctor. The clinic has been approved for telemedicine for mental health patients and the rules are being relaxed to allow telemedicine for other patients with payment.

Louisiana Department of Education Request for Waivers

On Monday, March 16, 2020, the Louisiana Department of Education requested that Governor, John Bel Edwards, waive a list of statues via Executive Order to allow educators to move forward and focus their attention on keeping students and teachers healthy and safe. 

Regulatory Flexibilities
Through existing BESE policy (Bulletins 111, 118, and 741) and the BESE policy waivers approved by President Holloway in the last few days, the following flexibilities are now in place:

  • School performance scores, district performance scores, and early childhood performance profiles for the 2019-2020 academic year will not be produced due to closures of 18+ days, per BESE’s long-standing policy to address severe disaster impacts on schools, centers and students.
  • Teacher evaluations can be completed with no further action, other than recording in the appropriate data system.   
  • Diploma requirements for graduating seniors, including requirements for minimum instructional minutes for course credit, industry-based credentials, and financial aid applications, have been waived.

Pursuant to the authority granted to the BESE President in LAC 28: I.305.B. to make ad hoc decisions for the board in times of emergency, and subject to ratification by the board, BESE President Holloway and Acting State Superintendent Beth Scioneaux are committed to immediately taking the following additional actions:

  • Submitting a waiver request to the U.S. Department of Education regarding 2019-2020 state assessment and accountability requirements;
  • Continue to offer access to optional state assessments, as desired by schools and parents;
  •  Exercising provisions in BESE policy that allow the Board to waive educator evaluations for the 2019-2020 year due to extenuating circumstances, thus allowing educators to renew or advance
    their credential without an evaluation in 2019-2020; and
  • Waiving end-of-course exam requirements for graduating seniors, as well as promotion rules for children in grades 4 and 8.

Statutory Flexibilities
Through a Proclamation, JBE-2020-27, issued by Governor Edwards, provisions of R.S. 17:154.1 have been waived, thereby relieving Louisiana public school systems of the required minimum number of instructional minutes for the 2019-2020 school year.

To provide additional flexibility, we request that the following laws below also be waived for the entirety of the 2019-2020 school year:

  • RS 17:10.1 — School and district accountability systems and the inclusion of value-added data in educator evaluations
  • RS 17:24.4 — LEAP statewide testing and pupil progression
  • RS 17:154.3 — Minimum number of days a classroom teacher must work in a school year
  • RS 17:391.2, et seq. — Public school accountability and assessments
  • RS 17:3881, et seq. — Teacher Performance Evaluation, teacher credentials based upon value added data
  • RS 17:3901, et seq. — Teacher evaluation, 50% of evaluation based on value-added data derived from student assessments
  • RS 17:3997(D) — Charter school teacher evaluations based upon value-added data derived from student assessments.
  • RS 17:4023 — Required student assessments for non-public schools participating in the Louisiana Student Scholarships for Educational Excellence program
  • RS 17:221 — Compulsory attendance law

On Tuesday, March 17, 2020, the Louisiana Department of Education requested that the U.S. Department of Education waive certain requirements outlined in  the Elementary and Secondary Education Act (ESEA) for the 2019-2020 academic year due to school closures because of COVID-19.

LDWF Offices Closed to the Public Indefinitely Starting March 17

Louisiana Department of Wildlife and Fisheries (LDWF) offices throughout the state will be closed to the public indefinitely beginning Tuesday, March 17.

To alleviate any additional public burden, LDWF is providing the public alternatives to process applications via mail, email and online.

Louisiana Law Enforcement Statement on COVID-19 Emergency Proclamation Restrictions

Louisiana State Law (RS 29:724) gives the Governor authority to set restrictions on gatherings and businesses in the interest of public safety and to prevent spread of COVID-19. These proclamations and declarations have the power of law.

As such, local, parish, and state law enforcement agencies as well as other state authorities including ATC and the State Fire Marshal, will be acting to enforce these rules set by the Governor.

Violations of gathering capacity and business hour restrictions may result in revocation of licenses and/or citations for violating the executive order under La. R.S. 29:724(E), Disturbing the Peace, or other appropriate violations of law.

Winn Parish School Board to Provide Meals to Children During School Closure

In a special meeting of the Winn Parish School Board on Tuesday, March 17, 2020, it was announced that the school board will provide meals to children under the age of 18 during school closure due to the Coronavirus.

Starting Monday, March 23, 2020, parents will be able to drive to a designated feeding to receive a pre-packed breakfast and lunch meal for all children under the age of 18 between the hours of 9:30 AM – 11:00 AM. Both breakfast and lunch will be distributed at the same time. Families will not be permitted to exit their vehicles or enter school buildings as part of the site protocol.

Parents are not required to pick up meals at the school their child is enrolled in. Parents will not be required to verify that their children are enrolled in school. Children are not required to be present with parents when they pick up meals but it is recommended if possible. All children will be fed.

No meals will be distributed during Easter break April 6th – 13th.

Winn Parish School Board Special Meeting to Address Cornovirus

The Winn Parish School Board (the Board) called a special meeting on Tuesday, March 17, 2020, to discuss operations during school closure due to the Coronavirus.

Superintendent, Steve Barlett asked the Board to approve a proclamation declaring a state of emergency that would allow the superintendent to lead the school boards response to the outbreak, entering into agreements with contracts, supply and organize the delivery of food to children in the parish 18 years and under, the authority to pay school employees their regular compensation during the period schools are closed, the authority to adjust curriculum, work schedules, staff assignments without further board approval, authority to adjust the school calendar, the authority to apply to BSSE, LDOE & USDOE any other government agencies for waivers of regulations or requirements, the authority to apply for reimbursements, waivers, grants and aide and other COVID-19 related items on behalf of the school board, the authority to provide non-mandatory supplemental resources to students, authority for the superintendent to take any action necessary to implement all directives received by the state. The board adopted the declaration.

At this time schools are scheduled to be closed until April  13, 2020, per directives issued by Governor, John Bel Edwards. All sporting events and practices are canceled until further notice. All sporting facilities at all school properties are closed. 

All school employees will continue to receive pay during the closure. Barlett stated that principles will be able to require staff to report to work at their discretion. 

The Board stated that there is a possibility that students will not return to school in this calendar year but that is unknown at this time. 

All seniors that are eligible to graduate will do so at some point. The exact date is not known at this time. 

The Board recommends that parents work with their children on reading and writing during their time off.

Many teachers are using online resources to communicate with students.

The Board will provide breakfast and lunch to all children under the age of 18 from Monday, March 23, 2020 to Friday, April 3, 2020.
